The nonrefundable fee for having a rezoning application considered is $15.00 + the cost of publication.   Under no circumstances shall all, or part, of this fee be refunded to applicant.

In order to address any questions or issues that may arise during this process, it is strongly suggested that the applicant/owner be present at all meetings during review of this application.   Unanswered questions or unresolved issues caused by the absence of the applicant may cause the application to be rejected.

If this application for ordinance amendment (rezoning) is approved by the City Council, the change in the map shall become effective thirty (30) days after final passage by the City Council.   This period of time will allow for recording and publication of the ordinance.   If this application is denied, the applicant/owner shall wait at least six (6) months before reapplying for reconsideration of this request.

REZONING PROCEDURE

Planning and Zoning Commission

  1. Come to the City Office for you complete packet.
  2. Application completed.
  3. Fee paid.
  4. Public hearing notice prepared, published in newspaper (not less than 7 days, more than 20 days before the date of the hearing).
  5. Agenda prepared, posted and mailed to P&Z Board.
  6. Notice provided to property owners within 300' of property under consideration.
  7. Meeting is held; a motion/second is made on a recommendation of application.
  8. Request, including application, minutes, and recommendation, passed to the City Council.

 

City Council

  1. Public hearing notice prepared, published in newspaper (same as above).
  2. Agenda prepared and posted.
  3. Notice provided to property owners within 300' of property under consideration.
  4. Consideration is given on the first reading of the ordinance amendment (rezoning).
  5. Consideration may be given by the council on the second and third reading of the ordinance amendment (rezoning).
  6. If all readings are approved, the ordinance amendment (rezoning) is approved, recorded, and published.
  7. Effective date of rezoning is established.
  8. If any reading is denied, the applicant's request fails and he/she may have to wait a specific period of time before reapplying for rezoning.
